Criminal Law
This project is reviewing the defence of insanity (section 23 of the Crimes Act 1961), and release arrangements for patients detained on the grounds of insanity or unfitness to stand trial. Some research and consultation has been undertaken. The Law Commission is working jointly with the Ministry of Health, with a view to the introduction of legislation reforming release arrangements later in 2010.
