58 Annual Report
Report on equal employment opportunities programme in
terms of the Crown Entities Act 2004, s. 151 (1)(g)
The Law Commission complies with the principles of being a good
employer.
It operates personnel policies containing provisions generally accepted
as necessary for the fair and proper treatment of its employees in all
aspects of their employment. It provides good and safe working
conditions to its employees. It provides opportunities for the
enhancement of the abilities of individual employees. The Commission
also recognises the aims and aspirations and employment requirements
and cultural differences of ethnic or minority groups.
The Commission operates an equal employment opportunities policy
where the best person for the job is employed. The Commission has
flexible employment arrangements, for example, to cater for those with
childcare responsibilities and those approaching retirement. There is
one woman Commissioner. Excluding secondees, 83% of employees as
at the balance date are women.
Report on acts in breach of statute in terms of the Crown
Entities Act 2004, s. 20(3)
The Law Commission did not carry out any act that is contrary to,
or outside the authority of an Act. All its actions were for the purpose
of performing its functions.
Report on permission to act despite being interested in a
matter in terms of the Crown Entities Act 2004, s. 68(6)
As a former Member of Parliament and a former Prime Minister, the
President of the Commission, Sir Geoffrey Palmer SC, is entitled to
certain payments under the Civil List Act 1979. As the Commissioner
leading the Commission’s project reviewing this Act, the President
declared this interest to the Minister Responsible for the Law
Commission by letter to Hon Annette King (28 August 2008).
The Commission’s review of the Act is not looking at the amount of the
payments under the Act but rather seeking to clarify the legislative
framework and improve transparency. On this basis the Minister gave
her permission for Sir Geoffrey to continue his role as Commissioner in
charge of this review.
