Project overview
In August 2000, The Law Commission was asked by the Ministry of Economic Development to review and report issues relating to Insolvency law. The topics which we were asked to consider were:
(a) the role of the State in insolvency law;
(b) whether additional provisions should be inserted into New Zealand law to deal with business rehabilitation or reorganisation;
(c) whether statutory management under the Corporations (Investigation and Management) Act 1989 should be retained in its existing or some modified form; and
(d) whether it was desirable for New Zealand to adopt a generic statute dealing with all insolvency law issues.
